Days of racing: 16 to 18 October 2009

First start: Friday, 16 October 2009 at 14:00 hours

Last possibility of start: Sunday, 18 October 2009 at 14:00 hours

Number of races: 9, whereof a maximum of two races to be performed on Friday.

Excluded scores: The worst 2 scores will be excluded if at least 8 races are completed, the worst score will be excluded if 5 to 7 races are completed, If 1 to 4 races are completed, the series score is the total of the race scores.

Entry fee: Boat incl. helmsman: 60,-- € Each crew member: 10,-- €

For H-Boat, Laser SB³, 20er Jollenkreuzer and Star:

Minimum entries: Classes of which less than 10 entries are registered by the entry closing date will not be started.

Entry closing date: Sunday, 04 October 2009

Late entries will be accepted until 15 October 2009, 20:00 hours, whereupon the entry fee increases by 20,-- €.

Social event: On Saturday, 17 October 2009, all sailors will be welcome for dinner which is going to be followed by a party.

Companions are welcome. Additional admission tickets will be available at a price of 15,-- € during the event.

Entries: Boats may enter online via the website of the BYC. A pre-entry-list can be found there as well.

It is expressly referred to the disclaimer of liability - cognovits clause.

Entered boats shall pay their entry fee even if they do not participate.

With the entry, all participants give their acceptance to a reporting and non-commericially use of photos from the event for publicity of the BYC.

Insurance Each participating boat shall be insured with a valid third party liability insurance which includes the race risk.

SI handing out: The program including sailing instructions will be available the day before the first race day, after 16:00 hours at the race office and by announcement at the bulletin-board.

The social event is subject to change by the organizers.

Scoring: The Low Point System of Appendix A will apply.

Prizes: Prizes will be given for the first quarter of each class, based on the number of entries on the closing date.

Returning of trophies: The winners are obliged to hand over the engraved challenge trophies to the race office of the BYC the following year at latest four weeks prior to the event.

Price giving: Except otherwise stated in the program, the price giving will take place approximately two hours after the finish of the last race on the premises of the BYC.

Sailing instructions: The regatta will be governed by the rules as defined in

 

» The ISAF Racing Rules of Sailing, latest edition, incl. their appendix of the German Sailing Federation (DSV),

 

» administrative regulations regatta-sailing of the DSV, latest edition,

 

» Class rules, accepted by the Technical Committee of DSV or ISAF,

 

» Sailing instructions of the NOR and the program. If there is a conflict between languages the German text will take precedence.

 

Advertising: The regatta will be classified as Category C acc. to ISAF-advertising-code.

Further information: In accordance with local law, parking at the BYC is only allowed with an oil protective awning under the motor of the car. Furthermore parking is limited on the BYC ground. Please also use the nearby parking areas on the island “Schwanenwerder” or at the “Strandbad Wannsee”.

Disclaimer of liability: The responsibility for the decision of a coxswain to participate in a race or to continue with it is solely with him;

To that extent he also takes the responsibility for his crew. The coxswain is responsible for the qualification and the correct

nautical conduct of his crew as well as for the suitability and the seaworthy condition of the registered boat.

In cases of Force Majeure or due to official directives or for safety reasons, the organizer is entitled to make changes in the accomplishment of the event or to cancel the event.

In these cases there does not exist any liability for compensation of the organizer to the participant.

In case of a violation of obligations that do not constitute primary respectively material contractual duties (cardinal obligations), the liability of the organizer, no matter because of which cause in law, for material and property damages of all kinds and their consequences that arise to the participant during or in connection with the participation in the event resulting from a conduct of the organizer, his representatives, servants or agents, is restricted to damages that were caused willfully or wantonly negligent.

When a violation of cardinal obligations occurs, in cases of simple negligence the liability of the organizer is limited to foreseeable, typically occurring damages. To the extent that the liability for damages of the organizer is excluded or restricted, the participant also relieves the staff - employees and representatives, agents, servants, sponsors and individuals who provide or drive salvage, safety or rescue vessels or assist with their use - from the individual liability for damages, as well as also all other individuals who were instructed to act in connection with the realization of the event.

The effective racing rules of the ISAF, the administrative regulations “regatta sailing” and the articles of association of the DSV, the class rules as well as the regulations of the invitation to the competition and the sailing instructions are to be complied with and are expressly recognized.

The German law shall prevail.
